What happens if I list counterfeit items or infringe on IP rights?
Under Shopee policy
Listings that are found to violate listing guidelines will either be suspended or deleted.
Deleted listings will incur penalty points under Shopee's Seller Penalty Points system. Selling privileges may be restricted for sellers with a high number of penalty points.
Shopee may also temporarily suspend, or terminate seller accounts with severe listing violations.
Under Singapore law
The police take a serious view towards IP rights infringement and will take action against those who disregard IP law.
In accordance with Trade Mark Act (Chapter 332), anyone who:
imports into Singapore for the purpose of trade or manufacture
sells, offers or exposes for sale
has in their possession for the purpose of trade or manufacture
any goods which a registered trade mark is falsely applied, shall be liable to a fine not exceeding $10,000 for each item (but not exceeding a total of $100,000) OR to imprisonment for a term not exceeding 5 years OR both.
